The controllers can no longer process the personal data in the event of the objection, unless compelling legitimate grounds for the processing can be demonstrated which override the interests, rights, and freedoms of the data subject, or the processing serves the establishment, exercise or defense of legal claims.
In order to exercise the right to object, the data subject may directly contact the controller(s) at Marco Simonetti at any time.
Automated individual decision-making, including profiling:
Each person whose data is processed has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or significantly affects him or her, as long as the decision is not necessary for entering into, or the performance of, a contract between the data subject and the data controller, or is based on the data subject’s explicit consent.

Collection, processing and use of personal data
Personal data:
Personal data is information about the factual or personal circumstances
Personal data is information about the factual or personal circumstances of an identified or identifiable natural person. This includes, for example, your name and email address.
Use of your data for marketing purposes:
Aside from using your data for sending out newsletters, we may also use your information to display personalized advertising to you.
Subscription to our newsletters
On Marco Simonetti’s website, users are given the opportunity to subscribe to our enterprise’s newsletter. The input mask used for this purpose determines what personal data is transmitted, as well as when the newsletter ordered from the controller.
Marco Simonetti regularly informs its customers and business partners by means of a newsletter about enterprise offers. The enterprise’s newsletter may only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter shipping. A confirmation email will be sent to the email address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. This confirmation email is used to prove whether the owner of the email address as the data subject is authorized to receive the newsletter.
During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a data subject at a later date, and it therefore serves the aim of the legal protection of the controller.
The personal data collected as part of the newsletter registration process will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by email, as long as this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. There will be no transfer of personal data collected by the newsletter service to third parties. The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data, which the data subject has given for shipping the newsletter, may be revoked at any time. For the purpose of revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller, or to communicate this to the controller in a different way.
Newsletter Tracking
The newsletter of Marco Simonetti contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such emails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, the Marco Simonetti may see if and when an email was opened by a data subject, and which links in the email were called upon by data subjects.
Such personal data collected in the tracking pixels contained in the newsletters are stored and analyzed by the controller in order to optimize the shipment of the newsletter, as well as to better adapt the content of future newsletters to the interests of the data subject. This personal data will not be passed on to third parties. Data subjects are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, this personal data will be deleted by the controller. Marco Simonetti automatically regards a withdrawal from the receipt of the newsletter as a revocation.
Cookies
The Internet pages of Marco Simonetti use cookies. Cookies are text files that are stored in a computer system via an Internet browser.
Many Internet sites and servers use cookies, and many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited Internet sites and servers to differentiate the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified using the unique cookie ID.
Through the use of cookies, Marco Simonetti can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.
By means of a cookie, the information and offers on our website can be optimized with the user in mind. Cookies allow us, as previously mentioned, to recognize our website users. The purpose of this recognition is to make it easier for users to utilize our website. The website user that uses cookies, e.g. does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user’s computer system. Another example is the cookie of a shopping cart in an online shop. The online store remembers the articles that a customer has placed in the virtual shopping cart via a cookie.
The data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and they may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software program. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely usable.
Log files
Each time you access Marco Simonetti’s webpages, usage data is transmitted via the respective Internet browser and stored in server log files. The stored data records contain the following data: the date and time of access, the name of the page accessed, IP address, referrer URL (original URL from which you arrived at the web pages), the amount of data transferred, and the product and version information of the browser used. The IP addresses of users are deleted or anonymised when you end your session on the website. When anonymising, IP addresses are modified so that the individual details about persons or factual circumstances can no longer be attributed to an identified or identifiable natural person or only if a significantly large amount of time, cost, and labour is expended. We evaluate these log file data records in an anonymous form in order to further improve our offering and make it more user-friendly, to find and correct errors more quickly, and to manage server capacity. For example, we can determine what times the Marco Simonetti website is especially popular and make the relevant data volume available to ensure you can make a purchase as quickly as possible. We can also identify and correct any errors on the Marco Simonetti website more quickly by analyzing the log files.
Web analysis
Google Analytics:
Google Analytics is a service of Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies, i.e. text files that are stored on your computer and allow Google to analyse the use of our website. The information recorded by the cookie on the use of our webpages (including your IP address) is usually sent to a Google server in the USA and stored there. Please note that Google Analytics is extended on our webpages with the code “gat._anonymizeIp();;” to ensure that IP addresses are collected anonymously (IP masking). We therefore ensure your IP address is only recorded by Google in abbreviated form, which ensures anonymity and prevents any conclusions being drawn about your identity. If IP anonymisation is activated on our web pages, your IP address will, however, be shortened beforehand by Google within Member States of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information to evaluate your use of our webpages to compile reports on the website activities and to provide further services associated with the use of webpages and the Internet for us. The IP address that your browser transmits as part of Google Analytics will not be associated with any other data held by Google. Google transfers this data to third parties only due to legal regulations, or in the context of order data processing. Google will not combine your data with other data collected by Google. By using these webpages you agree to the processing of data collected about you by Google, and in the manner described and for the aforementioned purpose. You can prevent the storage of cookies by selecting the corresponding setting in your browser software. However, please note that you may not be able to use all of the functions on our webpages if you choose this option. You can also prevent Google’s collection and use of data generated by the cookie and related to your use of the website (including your IP address) by downloading and installing the browser plugin available at the following link: tools.google.com/dlpage/gaoptout?hl=en.
Facebook pixels:
We use Facebook pixels to show you advertising based on your activities on our webpages and tailor it to your interests via re-targeting on Facebook, Instagram, Facebook Messenger, and Facebook Audience Network.
LinkedIn pixels:
We use LinkedIn pixels to show you advertising based on your activities on our webpages and tailor it to your interests via re-targeting on LinkedIn.
Social plugins
Our website uses social plugins from different social networks. With the help of these plugins, you can, for example, share content or recommend products to other persons. The plugins are enabled by default on Marco Simonetti’s website. The content of the plugin is transmitted from the social network directly to your browser and then incorporated by the latter into the webpages. By incorporating the plugin, the social network receives the information that you have accessed the corresponding page of our website. If you are logged into a social network, the latter can assign your visit to your account. If you interact with the plugins, for example, by clicking the Facebook “like” button or leaving a comment, the corresponding information is transmitted from your browser directly to the social network and stored there. For information on the purpose and scope of data collection and further processing and use of data by social networks, as well as your rights in this respect and settings options for protecting your privacy, please refer to the data protection guidelines of the respective networks or websites. Even if you are not logged into social networks, data can still be sent from websites with active social plugins to the networks. Because of an active plugin, every time the website is accessed, a cookie with an identifier is stored. Since your browser will send this cookie every time you connect to a network server without being requested, the network can theoretically create a profile of which webpages the user associated with the identifier has accessed. And it would also be possible later on to link this identifier to a person again, for example when logging into a given social network. We use the following plugins on our website: Facebook, Twitter, and LinkedIn. If you do not want social networks to collect data about you via active plugins, you can select the “block third-party cookies” function in your browser settings. Then, where there is embedded content from other providers, the browser will not send any cookies to the server. However, when using this setting, other cross-page functions may no longer work
